SMB, in application of the valid personal data protection regulation, informs that the collected personal data through the web page´s contact form will be included in the automated specific user folders regarding SMB´s services.

The automated personal data collection and processing has a final goal of maintaining the commercial relationship and performing information, training, advisory and other SMB activities.

These data will not be transferred to any entity external to SMB, unless there is any obligation or legal mandate.

SMB implements the required measures to guarantee the safety, integrity and confidentiality of the data in accordance with the provisions of the (EU) 2016/679 Regulation of the European Parliament and the Council, April 27 the 2016, in relation to natural persons’ protection as far as the personal data processing and free circulation of these are concerned.

The user may exercise the rights to access, correction, cancellation and opposition conferred on the previously mentioned Regulation (UE). The exercise of these rights may be performed by the user via email to

The user declares that all the data to be provided by him/her are true and correct, and is committed to keep them updated, letting SMB know about any changes.


Personal data processing purpose:

What is the data processing purpose?

  1. If the services are hired, the purpose would be to maintain the commercial relationship, as well as the management, administration, information, provision and improvement of the service.

  2. Sending of the requested information through the appropriate digital or printed forms.

  3. Newsletter forwarding, as well as commercial communications such as promotion and/or advertising from the company or the industry. In this case, a separate checkbox is shown on the contact forms and agreements to be voluntarily marked by the user if he/she wishes to receive said information. Note: The user may oppose to the sending of commercial information at any moment, by forwarding an email to the previously stated email address.

How long will be the gathered data kept for?

The provided personal data will be kept as long as there is a commercial relationship and there is no cancellation application. Subsequently, the data will be kept during the legally demanded terms (except when, the processing is based on the user´s consent and he/she revokes it, in which case the data will be kept until receiving the revocation request). Therefore, we can guarantee that your data will not be kept for longer than required for the previously established purposes, notwithstanding the conservation needed for the drafting, the exercise or the defense of potential claims and/or as long as the applicable legislation would allow it.



The data processing will be conducted and legitimized according to the following legal bases:

  1. The information application and/or the SMB service procurement, which terms and conditions will be made available in every case previously to a potential contracting.

  2. The free, specific, informed and unambiguous consent, whilst we hereby inform you by providing the present Privacy Policy, which upon reading, in the case of agreeing with, you may accept through the declaration or a clear affirmative action, such as ticking the checkbox arranged for that purpose.

In the case that we do not receive your details or the provided details are erroneous or incomplete, we will not be able to serve the application, making it impossible to provide you the requested information or to carry out the service procurement.


The data will not be shared with any third party unrelated to SMB, except for legal obligation. An optimum service delivery that SMB offers may require third parties to SMB to access the user´s data as processing managers.

In addition, SMB may perform personal data transfers or communications to meet its obligations with the Public Administrations when the current legislation requires it so at every moment and if necessary to other entities like the State’s security forces and the Judicial authorities.

Users’ Rights

SMB informs the user about the possibility to exercise the rights to access, correction, cancellation, opposition, portability and limitation of the processing, as well as rejecting the automated processing of personal data gathered by SMB.

These rights may be freely exercised by the user, and when necessary whoever represents it by means of, a written and signed application to Said application must include the following data: Name and last name of the user, address for notifications, valid national identity card photocopy, and petition concerning the application.

In addition to the previous rights, the user shall have the right to revoke the granted consent at any moment through the procedure described above. This revocation shall never affect the legality of the processing previous to its removal. SMB shall be able to keep processing the user´s data as long as the applicable legislation allows it.

SMB reminds the user that he/she has the right to present a claim before the appropriate control authorities.

Implemented safety measures

SMB commits to comply with its obligation to keep the personal data and its duty to keep them, and shall adopt the required measures to avoid its alteration, loss, processing or non-authorized access, according to what is stated by the applicable regulation.

SMB has implemented the required technical and organizational safety measures to guarantee the safety of its personal data and avoid its alteration, loss and processing and/or non-authorized access, taking into account the state of the art, the nature of the stored data and the risks they are exposed to, either if they come from human actions or the physical or natural environment, according to the applicable regulation.

SMB, an entity worried about the privacy, in order to reinforce the confidentiality and integrity of the information in its organization, continually maintains the supervision, control and evaluation of its processes to ensure the respect to privacy and safety of the information, according to the international standards.

Hosted information protection

SMB makes back-up copies of the hosted contents on its servers, although it is not responsible for the loss or the accidental deletion of the data by its users. Likewise, it does not guarantee the total replacement of the deleted data by the users, as those data could have been removed and/or modified during the period of time elapsed since the last back-up copy.

The offered services, except for those specific to e back-ups specifics, do not include the replacement of the stored data in the back-up copies made by SMB, when this loss has been caused by the user; in this case, a fee will be established according to the complexity and volume of the retrieval, always previously accepted by the user.

The replacement of the deleted data is only included in the service price when the content loss has been caused by SMB.

Commercial communications

In application of the LSSI, SMB shall not send advertising or promotional communications via email or other electronic communication methods that had not been previously requested or specifically authorized by the recipients.

In the case of users who keep a previous contractual relationship, SMB shall be authorized to send commercial communications referring to products or services similar to those to which were initially contracted by the client.

In any case the user, after accrediting its identity, could request to stop the sending of commercial information through the previously established channels.
